PakTaleem Terms and Policies
PakTaleem operates as a comprehensive e-learning business partner specializing in Moodle LMS solutions. These Terms and Policies govern the use of our services, including E-learning Development, Instructional Design, Managed E-Learning Hosting, and E-learning Administration.
A. Terms and Conditions (T&C)
1. Acceptance of Terms
By ordering or utilizing services from PakTaleem, the Client agrees to be bound by these Terms and Conditions, which apply to all subscription plans, hosting packages, and custom development projects.
2. Scope of Service and Utilization
- Subscription Plans: Services are provided on a monthly subscription basis, corresponding to the specific package (e.g., Silver, Gold, Platinum, Diamond Administration plans or eTeacher, eAcademy, eInstitute, eCorporate Hosting packages) selected by the Client.
- Resource Limits: Services are subject to defined limits, including **Maximum Administration Hours** and **Supported Users/Concurrent Users** (for Hosting packages).
- Exceeding Limits: If the Client requires administration, development, or support hours beyond those allocated in the chosen package, such additional hours will be charged separately. The standard rate for additional administration or hosting hours is typically $15/hour.
- User Management (Hosting): For hosting packages, the Client is responsible for managing the number of users to remain within the package limit. Clients can delete previous users and add new users to maintain the required numbers.
3. Payment and Billing
- Fees: The Client agrees to pay the monthly subscription fee for the chosen plan.
- Setup Fees: Hosting packages require a one-time Setup Fee, ranging from $200 to $800, payable upon initial order.
- Taxes: All stated prices for hosting and administration plans are exclusive of taxes and fees.
- Upgrades: Clients may upgrade their plans at any time to access higher resource limits.
4. Data Management and Backups
- Backup Frequency: PakTaleem commits to performing data backups according to the schedule specified in the purchased plan (e.g., Monthly, Bi-weekly, Weekly, Daily, or As desired).
- Data Migration: If a Client is already running a Moodle LMS and chooses PakTaleem hosting, their LMS will be migrated to PakTaleem hosting free of cost.
- Client Backup Access: PakTaleem offers a full backup of the hosted LMS if the Client decides to migrate to a different host.
5. Subscription Termination and Cancellation
- Client Cancellation: Clients utilizing subscription-based access may be able to cancel their subscription at any time.
- Consequence of Cancellation: Upon cancellation of a subscription, the user is automatically logged out and access is terminated.
B. Privacy Policy
This policy outlines how PakTaleem handles the data of its clients and their end-users/students in the course of providing LMS hosting and administration services.
1. Data Collection and Usage
- End-User/Student Data: PakTaleem handles student data, including enrollment status, course progress, profile information, and activity details. This data is used to provide administration services, end-user support, and reporting functions for the Client.
- Authentication Data: PakTaleem develops custom authentication features, such as SMS and Phone Authentication plugins, which collect mobile numbers during sign-up for verification purposes.
- Data Reporting: PakTaleem develops APIs to make student data, such as grades, available externally to other systems as required by the Client.
2. Data Security and Confidentiality
- Commitment to Security: PakTaleem implements advanced security protocols to safeguard sensitive data and protect the LMS from potential threats.
- Confidentiality: All user data, including mobile numbers collected via authentication plugins, is handled with the utmost confidentiality, ensuring the privacy and trust of users.
3. Data Retention and Destruction
In certain customized projects, PakTaleem has implemented a data management strategy that includes the scheduled periodic deletion of user data from the database, such as after six months. Data retention periods are managed according to client instructions and system needs.
C. Refund Policy
This policy governs refunds for PakTaleem's subscription-based services, hosting fees, and custom development projects.
1. Subscription Services (Hosting, Administration, All-in-One Support)
Monthly fees for subscription services are paid in advance for allocated resources, including administration hours and web space. Since resources are immediately reserved and utilized throughout the billing cycle, monthly subscription fees are generally considered **non-refundable**. If a Client cancels a service, access will typically continue until the end of the paid billing cycle.
2. Setup Fees
Hosting packages require a one-time Setup Fee ($200 to $800). This fee covers the initial configuration, customization, LMS setup, and migration services. This fee is **non-refundable** once the setup and customization work has commenced.
3. Custom Development and Hourly Charges
- Hourly Work: Fees paid for custom development (e.g., plugins, instructional design, theme development) or charges for additional administration time (typically $15/hr) are **non-refundable** once the service has been completed and delivered to the Client or the hours have been rendered.
- Unused Hours: Subscription plans allocate a maximum number of dedicated hours per month. These hours do not typically roll over, and no refund will be issued for allocated hours that were not consumed by the Client within the designated billing period.
